Rest Easy Rentals Waiver
1. Rental Items:
The Rental Company agrees to provide camping equipment to the Renter, as specified in the booking and outlined in the attached Packing Slip. The Renter acknowledges that the equipment details on the website are accurate and the equipment is in good working condition at the time of rental.
2. Rental Period:
The rental period begins on the agreed-upon start date and concludes on the specified end date. The Renter must return the equipment by the agreed-upon time on the last day of the rental period.
3. Rental Fee:
The Renter agrees to pay the total rental fee as displayed on our website upon booking. Payment may be made at the time of booking or through our online payment system.
4. Security Deposit & Financial Responsibility:
A security deposit is required as indicated during the booking process. This deposit will be refunded to the Renter upon the satisfactory return of the equipment, minus any charges for damages, lost items, or late fees, if applicable. The Rental Company does not provide insurance coverage for the rented equipment. The Renter is responsible for obtaining appropriate insurance coverage if necessary.
Financial Responsibility Clause:
- In the event that the equipment is lost or stolen, the Renter will be charged the full replacement cost of the equipment.
- If the value of the lost or stolen equipment exceeds the security deposit, the Renter agrees to have the additional amount charged to their credit card on file.
- If the equipment is damaged and the repair costs exceed the security deposit, the Renter agrees to have the additional amount charged to their credit card on file.
- If the equipment is returned late and the total late fees exceed the security deposit, the Rental Company reserves the right to charge the Renter's credit card on file for the remaining balance.
- If the Renter fails to provide a valid credit card or the payment is declined, they will be subject to legal action to recover the outstanding balance.
By renting equipment from us, the Renter agrees to these terms and authorizes Rest Easy Rentals LTD to charge their credit card for any applicable additional costs.
5. Care and Responsibility:
The Renter agrees to use the camping equipment with care and in a responsible manner, following all safety guidelines provided by the Rental Company.
The Renter assumes full responsibility for:
- Any damage, loss, or theft of the equipment during the rental period.
- Ensuring that all equipment is returned in clean, functional condition. Failure to do so may result in cleaning or damage fees.
- Using the equipment for its intended purpose only. Any misuse resulting in damage will be charged accordingly.
6. Late Returns & Additional Charges:
Rest Easy Rentals LTD operates on a 24-hour rental period.
- Failure to return the equipment on time will result in an additional full-day charge per rental item.
- If the late fees exceed the security deposit, the remaining balance will be charged to the Renter's credit card on file.
- If the Renter fails to return the equipment within 48 hours of the agreed return date without communication, the Rental Company reserves the right to charge full replacement costs for all unreturned items.
7. Cancellations:
- Cancellation by the Renter must be made at least 48 hours before the start of the rental period to receive a full refund.
- Cancellations made within 48 hours of the rental start date may incur a cancellation fee as indicated on our website.
8. Insurance:
The Rental Company does not provide insurance coverage for rented equipment. The Renter is responsible for obtaining any necessary insurance.
9. Indemnification:
The Renter agrees to indemnify and hold harmless the Rental Company from any liability, claims, or expenses arising from their use of the camping equipment.
10. Governing Law:
This Agreement shall be governed by and construed in accordance with the laws of Alberta, Canada. By renting equipment from Rest Easy Rentals LTD, you agree to adhere to the terms and conditions outlined in this policy, including your financial responsibility for damages, late returns, and losses.
